Terms and Conditions for Base

These Terms and Conditions ("Terms") govern your access to and use of Base, software developed and maintained by oxyio.com.
Definitions
For the purposes of these Terms and Conditions:
- "We", "Us", or "Our" refers to the entity that develops and maintains Base.
- "You" or "User" means any individual or entity who accesses, uses, or interacts with Base.
- "Base" refers to the software product, including all associated code, documentation, services, and updates made available under these Terms.
- "Terms" means these Terms and Conditions, including any updates, amendments, or addenda.
- "License" refers to the license under which Base is made available.
- "Use" includes accessing, installing, executing, modifying, distributing, or interacting with Base in any way.
1. License: Capacity to Pay
Base is licensed under a Capacity to Pay model, designed to promote sustainable development through contributions aligned with your means.
This includes, but is not limited to:
- Financial contributions (e.g., sponsorships or donations);
- Code contributions (features, bug fixes, documentation);
- Community participation (support, testing, feedback).
Continued use without a good-faith contribution, may constitute a breach of license. Full license details are available in the LICENSE file.
2. Permitted Use
You are permitted to use, modify, and distribute Base, provided that you:
- Adhere to the terms of the Capacity to Pay license;
- Do not misrepresent the origin of the software;
- Do not use Base for unlawful, harmful, exploitative, or malicious purposes;
- Do not create or offer a similar service or product - hosted or not - that replicates core functionality of Base.
- Accept full responsibility for the consequences of your use and any modifications or derivative works you create.
3. No Warranty
Base is provided on an “as-is” and “as-available” basis, without any warranties or guarantees of any kind—whether express, implied, or statutory.
We make no assurances that Base will be error-free, secure, continuously available, or suitable for any particular purpose. You use Base entirely at your own risk.
4. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of or inability to use Base—even if we have been advised of the possibility of such damages.
5. Security and Legal Compliance
Base includes cryptographic and networking features designed to support secure operations. However, it is your responsibility to ensure compliance with applicable laws, regulations, and industry standards in your jurisdiction when deploying or integrating Base.
6. Modifications to Terms and Software
We reserve the right to modify these Terms or update the Base software at any time. Material changes to the Terms will be communicated through the project repository. Your continued use of Base after any such changes constitutes your acceptance of the revised Terms.
7. Third-Party Dependencies
Base may rely on or integrate with third-party software, services, or libraries. Use of such dependencies is governed solely by the terms of their respective licenses. We accept no liability for issues arising from such third-party components.
8. Contributions and Feedback
By submitting any form of contribution to Base (including source code, documentation, or suggestions), you grant us a perpetual, worldwide, irrevocable, sublicensable, royalty-free license to use, reproduce, modify, publish, and distribute your contributions as part of Base or related projects.
9. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which we are headquartered. You agree that any disputes arising under or in connection with these Terms shall be resolved exclusively in the competent courts of that jurisdiction.
10. Redistribution and Commercial Use
You may redistribute Base for non-commercial purposes, provided that:
- These Terms and the LICENSE.md file remain intact and unmodified;
- You do not misrepresent your relationship with us;
- You do not offer Base or derivative works as a direct or hosted alternative to Base without prior written permission.
Commercial use is permitted provided it aligns with the terms of the License, including fair contribution.
11. Fair Use and Good Faith
You agree to use Base in a fair, respectful, and non-abusive manner. Actions that intentionally harm the software ecosystem, circumvent license intent, or damage our reputation (including commercial exploitation without contribution) may result in revocation of access to official resources, community participation, or future updates, etc.
12. Disclaimer of Warranty (Full Legal Version)
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
13. Entire Agreement
These Terms constitute the entire agreement between you and us with respect to Base, and supersede all prior or contemporaneous understandings, communications, and agreements, whether written or oral, regarding its subject matter. No amendment to these Terms will be effective unless made in writing and published by us.
